GENERAL TERMS AND CONDITIONS OF SALE AND USE

1. Purpose and scope
These General Terms and Conditions of Sale and Use govern the purchase, booking, contracting and use of classes, activities, services, packages, passes, subscriptions, memberships and spaces offered by Tabula Rasa Barcelona, S.L., both through the website www.tabularasabcn.com, as well as through booking and payment platforms, official communication channels and the physical studio.
Tabula Rasa offers physical, mental and emotional wellbeing services, including, among others: yoga, pilates, pilates reformer, barre, dance, workshops, therapies, coworking, space rental, events and special activities, activities related to holistic health and wellbeing.
The above list is illustrative and may vary depending on the services available at any given time.
The purchase or booking of any service, the acquisition of a package, pass, subscription or membership, participation in an activity or use of Tabula Rasa's facilities implies that the user has read, understood and accepted these Terms and Conditions.
Certain services may be subject to specific terms. In such cases, the specific terms will be provided before the relevant booking, purchase or contract is completed and will supplement these Terms and Conditions. In the event of any conflict, the specific terms applicable to the relevant service shall prevail, provided that they do not conflict with applicable law.

Hereinafter, “Tabula Rasa”, “the Centre”, “we” or “the Company”.
3. Services offered, content and availability
Information relating to the services, activities, schedules, professionals, availability, prices, duration, characteristics and other relevant aspects will be provided on the website, through the relevant booking platform, through Tabula Rasa's official communication channels or in the applicable specific terms.
The content, schedules, professionals, characteristics and availability of the services may be modified, suspended or cancelled in accordance with the organisational, operational, technical or other requirements of the Centre.
Tabula Rasa will endeavour to inform affected users of relevant changes or cancellations as far in advance as possible, whenever circumstances allow.
The duration, validity, terms of use and specific characteristics of each class, package, pass, subscription, membership, workshop, therapy or service shall be those indicated in the relevant description or at the time the purchase or booking is completed.
4. Prices and payment platforms
Prices for classes, packages, passes, subscriptions, memberships, workshops, therapies and other services will be available on the website, through the relevant booking or payment platform, or directly at the Centre.
All prices will be stated in euros (€) and will include applicable taxes, unless expressly stated otherwise.
Payments may be made through the platforms, systems and payment methods available at any given time.
Amounts paid are non-refundable, except in the cases provided for in these Terms and Conditions, the applicable specific terms, in the event of an error attributable to Tabula Rasa, or where required by applicable law.
Tabula Rasa reserves the right to modify prices and fees at any time. Such changes will not affect purchases or bookings that have already been confirmed and paid for, unless otherwise required by applicable law.
For products subject to recurring renewal, any change in the applicable fee will generally take effect from the relevant renewal date, without prejudice to any applicable prior information requirements.
5. Packages, passes, subscriptions and memberships
Packages, passes, subscriptions and memberships shall have the duration, number of sessions, validity period, expiry date and terms of use indicated at the time of purchase or in the description of the relevant product.
Packages, passes, subscriptions, memberships and credits are personal and non-transferable, unless expressly stated otherwise.
As a general rule, packages, passes, subscriptions and memberships are not eligible for returns or monetary refunds, except where there is a justified reason, an administrative error or an error attributable to Tabula Rasa, a specific provision in these Terms and Conditions, or a right granted under applicable law.

Cancellation or termination of a subscription must be notified at least 15 days before the start of the next renewal cycle. For example, if a subscription renews on the 20th of each month, the cancellation request must be submitted no later than the 5th of that same month.
Expired packages, passes, subscriptions or memberships may not be used or reactivated, unless Tabula Rasa expressly establishes an exception.
Unless expressly stated otherwise, unused sessions, credits or services may not be accumulated or carried over beyond the applicable validity period.
6. Bookings
Advance booking is required to guarantee a place in a class, activity, therapy session, coworking service or any other activity requiring registration.
Bookings must be made through the platform, application, website or channel authorised by Tabula Rasa.
Persons without a prior booking may only access the relevant service if capacity is available and Tabula Rasa authorises such access.
The user is responsible for ensuring that the information provided during the booking or purchase process is correct, complete and up to date.
A booking shall be considered confirmed when confirmation has been issued by the relevant platform or by Tabula Rasa and, where applicable, the payment process has been successfully completed.
7. Cancellations by the user and return of credits
In the case of single classes, packages, passes, subscriptions or memberships, the user may cancel a booking at least 8 hours before the scheduled start time of the class or activity.
When the cancellation is made within the established time limit, Tabula Rasa will return the corresponding credit to the user's account or balance.
The return of the credit will not, under any circumstances, entail a refund of the monetary amount paid for the class, package, pass, subscription or membership.
The credit will be returned within a maximum of 5 business days from receipt and validation of the cancellation.
The returned credit will remain subject to the validity, use and expiry conditions applicable to the purchased product.
Where cancellation is notified less than 8 hours in advance, the credit will not be returned and the class or activity will be considered used.
Cancellations must be processed through the applicable booking platform or through another channel expressly authorised by Tabula Rasa.
8. Workshops, courses, events and special activities
Workshops, courses, events and special activities may be subject to specific booking, cancellation, credit return, rescheduling or refund conditions.
Such conditions will be provided at the time of registration, booking or purchase.
Unless the specific terms expressly provide otherwise, cancellation of a workshop, course, event or special activity will not entitle the user to the return of any credit or to a monetary refund.
9. No-shows
A no-show shall mean failure to attend a booked class, activity, workshop, event, session or service without having cancelled it within the applicable cancellation period.
In the event of a no-show, no credit will be returned and no monetary refund will be provided.
The relevant session, credit or access entitlement will be considered used.
10. Access and punctuality
Users are advised to arrive at least 5 minutes before the start of the class, activity or session.
To ensure the proper development of activities and maintain the concentration and experience of the group, access to the room will close at the scheduled start time of the class.
Once the class or activity has started, entry will not be permitted.
If a person is unable to access the class due to late arrival, the relevant booking or credit will be considered used and will not entitle the user to a credit return or monetary refund.
11. Cancellations or changes by Tabula Rasa
Tabula Rasa may modify, reschedule or cancel a class, activity, workshop, event, therapy or service for organisational, operational, technical or safety reasons, force majeure or any other reasonable cause.
When Tabula Rasa cancels a service, the user will be offered, depending on the circumstances and nature of the service, the option to:
Reschedule the class, activity or service.
Receive the corresponding credit.
Receive a refund of the amount paid, where applicable.
The specific terms applicable to workshops, courses, events and special activities may establish particular solutions in the event of cancellation or modification.
12. Behaviour, respect and rules of conduct
All users are expected to behave respectfully towards the Tabula Rasa team, professionals, collaborators and other participants.
During classes and activities, mobile phones must remain switched off, on silent or in airplane mode, unless their use is expressly authorised.
Users must refrain from conduct that may interrupt activities, disrupt coexistence, compromise safety or negatively affect the wellbeing or experience of others.
Any disrespectful behaviour, inappropriate conduct, harmful behaviour or repeated breach of the rules may result in restricted, suspended or denied access to the Centre or its services, without entitlement to the return of credits or any monetary refund, without prejudice to any rights that cannot be restricted or excluded under applicable law.
13. Health, physical condition and user responsibility
Participation in Tabula Rasa's classes, activities and services is voluntary and may involve a certain level of physical effort and risks inherent to the practice.
By participating in an activity, the user declares that, to the best of their knowledge, they are in suitable physical and mental condition to participate and that they do so voluntarily and responsibly.
The user is responsible for:
Informing the teacher, therapist or relevant professional, before the activity begins, of any condition, limitation or relevant circumstance that may affect their participation, including injuries, pregnancy, illnesses or other relevant circumstances.
Listening to their body and adapting their practice to their personal needs, abilities and limits.
Following the instructions and reasonable adaptations provided by professionals.
Stopping the activity and informing the relevant professional if they experience pain, discomfort, dizziness or any other concerning symptom.
Consulting a healthcare professional before starting physical activity if they have any doubts about their health or whether participation is appropriate.
Tabula Rasa, its instructors, professionals and collaborators shall not be liable for injuries, discomfort, damage or aggravation of pre-existing conditions arising from irresponsible practice, failure to disclose relevant circumstances, failure to follow the instructions provided, or causes not attributable to Tabula Rasa.
This provision shall apply without prejudice to any liability that cannot be excluded or limited under applicable law.
14. Image rights
During classes, activities, workshops or events, Tabula Rasa may take photographs or audiovisual recordings for communication, information and promotional purposes relating to its activities, including publication on the website, social media, advertising materials or other communication channels operated by Tabula Rasa.
Where applicable law requires the consent of the individual concerned for the capture or use of their image, such consent will be obtained through the relevant mechanism and separately from acceptance of these Terms and Conditions.
Persons who do not wish to appear in photographs or recordings may expressly inform the Tabula Rasa team before the activity begins. Tabula Rasa will take reasonable measures to avoid including them in photographs or recordings, provided this is technically and organisationally possible.
Refusal to authorise the use of one's image will not affect ordinary access to services, unless the specific nature of the activity makes image capture essential and this circumstance has been communicated in advance.
15. Use of facilities and materials
Users must use Tabula Rasa's facilities, spaces, equipment and materials appropriately, responsibly and respectfully.
Each participant must contribute to maintaining the cleanliness, order and proper condition of shared spaces.
Users must follow the instructions provided by staff or professionals regarding the use of equipment and materials.
The user shall be responsible for intentional damage or damage caused by manifestly improper use of spaces, furniture, equipment or materials and, where applicable, shall bear the reasonable costs of repair or replacement.
Tabula Rasa reserves the right to refuse admission or access in cases of inappropriate behaviour, unsafe conduct, disrespect or repeated breaches of the rules, within the limits established by applicable law.
16. Personal belongings
Users are responsible for the safekeeping of their personal belongings during their stay at the Centre.
Tabula Rasa shall not be liable for the loss, theft or damage of personal belongings within its facilities, unless such loss or damage results from an action legally attributable to Tabula Rasa.
Users are advised not to bring valuables and to use the designated areas for storing belongings at their own responsibility.
17. Space rental, coworking and special services
Space rental, coworking services, therapies, private events and other special services may be subject to specific terms.
These terms may include, among other aspects:
Availability and booking procedures.
Access and usage hours.
Deposits, advance payments or guarantees.
Cancellation, rescheduling and refund conditions.
Capacity limits.
Authorised use of spaces and materials.
Responsibilities relating to damage caused.
Technical, set-up or equipment requirements.
The applicable specific terms will be provided before the relevant booking or contract is completed.
18. External platforms
Certain bookings, purchases, payments or services may be managed through external platforms, including, among others, Mindbody, ClassPass, Urban Sports Club and Wellhub.
Use of these platforms may be subject to their own terms and conditions, privacy policies, booking rules, payment conditions and other applicable documents.
Tabula Rasa is not responsible for the technical operation, availability, account management, platform-specific incidents or internal policies of such external platforms.
This does not exclude any liability that may apply to Tabula Rasa for services provided directly by it, in accordance with applicable law.
19. Right of withdrawal in distance contracts
Where a consumer enters into a service contract remotely, they may have a statutory right of withdrawal under the terms and subject to the exceptions established by applicable law.
As a general rule, the withdrawal period for distance contracts for services is 14 calendar days from the conclusion of the contract, without prejudice to applicable legal exceptions.
Where the user expressly requests that performance of the service begin before the statutory withdrawal period has expired, they may be required to pay the proportionate amount corresponding to the service already provided, in accordance with applicable law.
Where the service has been fully performed and the applicable legal requirements are met, the right of withdrawal may cease to apply.
The booking cancellation conditions established in these Terms and Conditions do not limit or replace any mandatory rights that consumers may have under applicable law.

20. Personal data protection
Personal data will be processed in accordance with the General Data Protection Regulation, applicable Spanish legislation and Tabula Rasa's Privacy Policy.
Data may be used, among other purposes, to manage bookings, purchases, payments, activities, service-related communications and other legitimate purposes duly disclosed to users.
Data subjects may exercise their applicable rights, including, as appropriate, rights of access, rectification, erasure, objection, restriction of processing and data portability, by sending a request to:

21. Limitation of liability
Tabula Rasa will provide its services with reasonable diligence and in accordance with applicable law.
To the extent legally permitted, Tabula Rasa, its instructors, professionals and collaborators shall not be liable for damages, injuries, losses or harm arising from:
Irresponsible practice or practice contrary to the instructions provided by professionals.
Failure to disclose injuries, limitations or other relevant circumstances.
Improper or unauthorised use of facilities, equipment or materials.
Acts or omissions of third parties beyond Tabula Rasa's reasonable control.
External causes, unforeseeable events or force majeure.
Technical or operational incidents attributable to external platforms.
Nothing in these Terms and Conditions excludes or limits Tabula Rasa's liability where such liability cannot be excluded or limited under applicable law.
22. Amendments to the Terms and Conditions
Tabula Rasa reserves the right to amend or update these Terms and Conditions where necessary to adapt them to legal, organisational, operational, technical or service-related changes.
The current version will be the version published on the Tabula Rasa website at any given time.
Changes will apply to bookings, purchases or contracts made from their effective date, without prejudice to acquired rights and applicable legal provisions.
Where required by law, users will be informed in advance of material changes that may affect them.
23. Severability
If any provision of these Terms and Conditions is declared null, invalid, illegal or unenforceable, that provision shall be interpreted or modified to the extent necessary to comply with applicable law.
The nullity, invalidity or unenforceability of any provision shall not affect the validity of the remaining provisions, which shall remain fully in force.
24. Applicable law and jurisdiction
These Terms and Conditions are governed by Spanish law.
Any dispute relating to the interpretation, application, validity or performance of these Terms and Conditions shall be submitted to the competent courts and tribunals in accordance with applicable law.
Where the user qualifies as a consumer, the mandatory rules on territorial jurisdiction established under applicable consumer protection legislation shall apply.
25. Acceptance and validity
The purchase or booking of any service offered by Tabula Rasa, as well as participation in its classes, activities, workshops, events, therapies or use of its facilities, implies that the user has read, understood and accepted these General Terms and Conditions of Sale and Use.
These Terms and Conditions may be amended or updated at any time. The current version will be the version published on the Tabula Rasa website at any given time and will apply to bookings, purchases or contracts made from its effective date, without prejudice to acquired rights and applicable legal provisions.
